On June 4, 2014, the Beijing Municipal Bureau of Human Resources and Social Security, together with Foreign Affairs Office of the People’s Government of Beijing and Beijing Municipal Education Commission released the Notice on Further regulating the Employment of Foreigners in Beijing (the “Notice”) to govern the employment of foreigners.
The Notice explicitly requires foreigners who work in Beijing to satisfy the following conditions: be of good physical health, lack any criminal record, be between 18 to 60 years old, hold a college degree or above and possess at least two years of related work experience. Effective from 31 October 2014, for application of employment of language teachers working in kindergarten, primary school, middle school, international school and other educational training institutes, foreign teachers should be holding teachers’ license issued by the home country authorities, otherwise with language certificate such as TEFL, TESL, TESOL, TKT or CELTA. Those who do not satisfy the diploma requirements but are advanced technological employees who plan to participate in vital technological development projects should possess foreign technological qualifications.
Foreign employees who come to work in Beijing should have an employer and possess valid passports or other international travel documentation. Foreign employees should also obtain work permits and residence certificates, and their employment should not exceed the scope of their work permits.
The Notice also requires employers to strengthen the management of foreign employee credentials. Employers should apply for termination of their foreign employees’ credentials after they end their employment relationships. This process should be conducted within ten days of dissolution or termination. For employees who leave their position without permission and cannot be located after 15 days, employers should issue a public notice for 10 days. If they are still unable to get in touch with the employee, the employer should submit a written application to the Human Resources and Social Security (Foreign Affairs Office) to terminate the out-of-contact employee’s certificates.
